Standard Terms & Conditions
In these terms and conditions “the proposal” means the works proposed to be carried out by us as outlined in any pricing estimates or supplied quotations and associated specifications.
The proposal is based on our appraisal of the site conditions from a visual inspection. We reserve the right to revise the pricing estimates, any supplied quotations, and the associated specifications at any time during the carrying out of the works should it become apparent that further work is in our opinion necessary or desirable on account of on-site obstacles, cabling access constraints, or any other matters which we consider may affect the proper implementation of the proposal. These might include, but are not limited to, existing distribution or switchboard design limitations; existing cabling condition; cabling and associated site installation access constraints; electrical or data installation problems; or existing equipment incompatibility or inadequacy.
The proposal has not allowed for any additional materials and or labour charges which may become applicable due to unknown cost variables which cannot be factored at this time other than what has been specifically itemised within this proposal.
Suitable access to all sub-floors, underfloor and ceiling areas must be made available to us at all times upon request to facilitate the proper implementation of the proposal.
All works involving the patching, painting, repairing or making good of surfaces such as walls, floors, skirting, architraves ceilings cornices, or eaves which may become dislodged, moved, cracked or otherwise damaged as a result of any core hole penetrations, vibration from drilling, wall chasing or installation and securing operations which are in our opinion necessary or desirable for the proper implementation of the proposal are excluded from it, and must be carried out by other contractors at your cost.
Works involving excavation of trenches, including but not limited to concrete core hole penetrations, concrete and or brick saw cutting to pathways, walls and or vehicular driveways as may be required for installation of electrical conduits, related cabling enclosures and ancillary equipment are excluded from the proposal and must be carried out by other contractors at your cost.
Any excavated trenches will be back-filled upon completion of associated works but making good repairs and re-instatement to the condition (prior) to when the works commenced including but not limited to pedestrian pathways, vehicular concrete driveways and brick walls, established garden lawns and soil beds, shrubs, rockeries, established plants and other vegetation are excluded from the proposal and must be carried out by other contractors at your cost.
Any associated works requiring the appointment of other persons such as sub-contractors and or service providers which may be required at any stage to facilitate the proper implementation of the proposal and have not been specified or itemised in it or which exceed the specified or itemised cost as detailed in the proposal are excluded and shall be at your cost or alternatively will become payable to us on demand. These may include but are not limited to the appointment of a “Service Provider” who is authorised to undertake restricted works on behalf of the “Utility and or Electricity Distributors Asset Infrastructure.”
The installation of circuit breakers and or safety switches during switchboard upgrades can give rise to tripping problems for some circuits when there are underlying existing faults present within the customers’ cabling infrastructure. Existing circuit or cabling faults may not be always readily identifiable during switchboard upgrades until such times as the new and or upgraded protection modules are energised from the distributor’s supply equipment. It may become necessary to undertake further fault finding to both locate and rectify pre-existing circuit and or cabling faults within the electrical installation in order to complete the proper implementation of the proposal.
Any circuit irregularities, including but not limited to safety switch faults identified during the associated works may necessitate further investigation to both locate and repair affected cabling and or ancillary connected equipment. Additionally any identified faults with switchboard circuit protection modules including the switchboard cabling harness and or downstream connected equipment will be advised in conjunction with practical remedies necessary to resolve the associated problems.
Any such costs associated with rectifying pre-existing circuit faults, associated cabling and switchboard circuit protection modules will become payable to us on demand in addition to the any pricing estimates or supplied quotations applicable for the proposal.
Any variations which you may require to the scope of the proposal or which are in our opinion necessary or desirable for the proper implementation of the proposal will incur additional charges. These may include but are not limited to hourly labour rates as set out below; the cost of any required additional materials and components; such further amounts as may relate to design, supervision and the like; and any expenses necessarily incurred by us in engaging the services of other parties.
Pricing:
This quotation is valid for 30 days from the date it bears.
All Purpose Hourly Rates:
Our hourly labour rate for variations is $ 90.00 per man hour plus GST.
If work is required to be performed outside of our normal business hours, the hourly labour rate is $100.00 per man hour plus GST.
Payment Schedule:
Our standard payment terms require an agreed deposit amount and may include a progress payment schedule with the balance payable upon practical completion or within 14 days from the invoice date.
No retention payments covering the defects warranty period as detailed above are to be withheld upon practical completion of the works (project) to K.M. Electrical Pty Ltd unless otherwise expressly agreed to in writing under the contract conditions.
Ownership of all equipment and associated materials utilised within this proposal remain the property of K.M. Electrical Pty Ltd until payment has been made in full under the contract conditions.
Warranty Period:
Our warranty period applies for 12 months from the date of practical completion of the works, and covers components and parts that we have supplied only, including our labour component.
This warranty does not include damage caused by user misuse and including but not limited to acts of vandalism, electrical power spikes and or surges, lightning strikes and or any other circumstances that are beyond our reasonable control.
